JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 24-01-2023 Learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month. Heard learned counsel for the petitioner as well as learned APP for the State.

The petitioner apprehends his arrest in connection with Bihta P.S. Case No. 588 of 2016, registered for the offences punishable under Sections 419, 420, 465, 467, 471/34 of the Indian Penal Code.

As per allegation, co-accused Om Prakash Rai has fabricated a sale deed in his name by an impostor impersonating the informant.

Learned counsel for the petitioner has submitted that petitioner is merely identifier. As a matter of fact, the informant Ramji Rai had executed the sale deed in favour of Om Prakash Rai

Patna High Court CR. MISC. No.8339 of 2022(4) dt.24-01-2023 2/2 and when the price of the land increased, he filed the case with false allegation.

Notice was sent to the informant and as per service report he has died and his son refused to receive the notice. The petitioner is merely identifier of the sale deed and he is a person of clean antecedent.

Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-2, Danapur, Patna in connection with Bihta P.S. Case No. 588 of 2016, subject to the conditions as laid down under Section 438(2) Cr.P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court. (Nawneet Kumar Pandey, J) SONALI/- U T
