2. Learned counsel for the petitioner is permitted to file supplementary affidavit on behalf of the petitioner in course of the day and the same is kept on record.

3. The petitioner has preferred this application for grant of regular bail in connection with Jagdishpur P.S. Case No. 135 of 2005 dated 28.06.2005 registered for the offences punishable u/ss 364, 302, 379, 201 of the Indian Penal Code and section 27 of the Arms Act.

4. As per the prosecution case, unknown miscreants are alleged to have abducted the driver of the informant and shot him dead.

5. Learned counsel for the petitioner has submitted that

Patna High Court CR. MISC. No.12180 of 2024(4) dt.29-04-2024 2/2 the petitioner is innocent and has falsely been implicated in this case. The petitioner is not named in the FIR. The name of the petitioner has sprung up in the confessional statements of the coaccused persons, Pappu Singh, Soeb Ansari and Siyaram Prasad. There is no eyewitness to the alleged occurrence. There is nothing on record except confessional statement. The petitioner has one criminal antecedent as stated in para 2 of the supplementary affidavit. The petitioner is in custody since 30.11.2023.

6. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Bhojpur at Arrah in connection with Jagdishpur P.S. Case No. 135 of 2005.

8. The application stands allowed.
