JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 28-02-2020 Heard learned counsel for the petitioners and learned Additional Public Prosecutor appearing on behalf of the State. The petitioners are apprehending arrest in connection with Baikunthpur P.S. Case No. 156 of 2019 for offences under Sections 147, 341, 323, 307, 379 and 504/34 of the Indian Penal Code.
Learned counsel for the petitioners submits that the petitioners have no criminal antecedent. He submits that specific allegation leveled against accused Saheb Prasad and Suraj Prasad whereas there is no specific allegation alleged against the petitioners. The allegation against the petitioners is general and omnibus in nature. It is further submitted that in fact the
Patna High Court CR. MISC. No.6944 of 2020(2) dt.28-02-2020 2/2 petitioners and the informant are Pattidars and on account of the land dispute, Title Suit No. 1404 of 2015 is going on between the parties.
Considering the aforesaid, this Court is inclined to grant bail to the petitioners. Let petitioners, above-named, in the event of arrest or surrender within four weeks from today, be released on bail on furnishing bail bond of Rs. 50,000/- (Rupees fifty thousand) each with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Gopalganj in connection with Baikunthpur P.S. Case No. 156 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
