Petitioner is not named in the first information report but when the victim was recovered, victim disclosed that he came to know about names of some of his kidnappers on the basis of their conversation. Furthermore, it would appear that some co-accused were arrested and they confessed their guilt disclosing name of the petitioner.

Moreover, co-accused Raushan Kumar Sinha @ Raushan Lala @ Putus and some others have already been granted privilege of bail by a bench of this court. Petitioner does not have any criminal antecedent.

Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge IX, Gaya
