Petitioner is accused in connection with Bhagwan Bazar P.S. Case No. 124 of 2014 registered under Section 364(A) of the I.P.C.
Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that petitioner is not named. In fact, the victim Abhisekh Tiwari is Bhagina (nephew) of the petitioner. In course of investigation, Shyam Pandey, brother-in-law of the petitioner, was apprehended by the Police, who gave his confessional statement regarding kidnapping of the victim with contention that this petitioner, being his Bhabhi, had come and asked for Rs. 3 lacs for approaching the bail of her husband Ram Kumar Pandey, who is in jail custody in Rajasthan for the N.D.P.S. Act. Except the confessional statement,
Patna High Court Cr.Misc. No.24568 of 2015 (3) dt.05-10-2015 2/2 there is nothing against the petitioner showing the conspiracy in kidnapping of the victim. It is also submitted that petitioner, being a lady, is in custody since 13.11.2014, having no criminal antecedent.
Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Saran at Chapra in connection with Bhagwan Bazar P.S. Case No. 124 of 2014.
