JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02/ 05.10.2015 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State.

Petitioner being headmaster of the school withdrew Rs 6,40,000/- for construction of the school building but he did work only to the tune of Rs 2,82,246/- and defalcated government money to the tune of Rs 3,57,754/-.

The contention on behalf of the petitioner is that due to some unavoidable circumstance, work could not be completed by the petitioner. Moreover, petitioner is in jail custody for four months and is ready to deposit the amount in question with the concerned department, if he is released on bail.

Considering the aforesaid submissions as well as facts and circumstance, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate, Danapur in Bihta

Patna High Court Cr.Misc. No.46540 of 2015 (2) dt.05-10-2015 P.S. Case no. 876/2014 subject to condition that he shall deposit the amount in question with the concerned department and shall produce receipt thereof before the concerned court within one year from the date of his release.
