This application has been filed for modification of order dated 20.01.2021 passed in Cr. Misc. No. 29271 of 2020 for extension of period of surrender.
Learned counsel for the petitioner has submitted that earlier petitioner was granted anticipatory bail by order dated 20.01.2021 passed in Cr. Misc. No. 29271 of 2020, whereby petitioner was directed to surrender before the court below within a period of eight weeks from the date of order, but the petitioner could not surrender within time, as due to typographical error in the address portion of original petition
Patna High Court CR. MISC. No.22258 of 2021(2) dt.07-04-2021 2/2 name of petitioner has been wrongly typed as Onkar Sah @ Onkar Kumar in place of "Omkar Sah @ Omkar Kumar" and alias name of father of petitioner i.e., "Naresh Sah @ Naresh Prasad @ Naresh Prasad Sah" has not been mentioned. Let the same be read as "Omkar Sah @ Omkar Kumar" in place of "Onkar Sah @ Onkar Kumar", and "son of Narayan Sah @ Naresh Sah @ Naresh Prasad @ Naresh Prasad Sah" in place of "son of Narayan Sah".
In view of the aforesaid fact, six weeks further time from the date of receipt of this order is allowed to the petitioner to surrender in the court below.
This modification application is accordingly, allowed to the extent as indicated above.
