2. The petitioner seeks bail in connection with Aurangabad (Muffasil) P.S. Case No. 279 of 2019 instituted for the offences under Sections 394, 395 and 120B of the Indian Penal Code.
3. The prosecution case is to the effect that three miscreants had intercepted the informant and they snatched away the motorcycle of the informant along with the mobile.
4. It is submitted by learned counsel for the petitioner that petitioner is not named in the FIR and his name has surfaced in the confessional statement of co-accused Pappu Yadav and Ashok Sao @ Ashok Shav. It is further submitted by learned

No.8940 of 2025(2) dt.05-05-2025 2/3 counsel for the petitioner that the co-accused Ashok Sao @ Asok Shav has been granted bail by a Co-ordinate Bench of this Court vide order dated 07.04.2021 passed in Cr. Misc. No. 348 of 2021 and the same is on record as Annexure-2. It is also submitted by learned counsel for the petitioner that the delay in approaching this Court was that the petitioner was not aware of the present case and the petitioner was taken on remand from another case in the present matter on 08.10.2024.
5. Learned Additional Public Prosecutor for the State has vehemently opposed the prayer for bail of the petitioner.
6. Considering the aforesaid submissions of respective counsels and taking into account the fact that the petitioner is not named in the FIR and in the confessional statement of coaccused the name of the petitioner has surfaced and also the fact that the petitioner is in custody since 08.10.2024, the petitioner above named, is directed to be released on bail on furnishing bail-bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Aurangabad (Muffasil) P.S. Case No. 279 of 2019, subject to the the following conditions:- (i) One of the bailors will be a

(ii) The petitioner will remain present on each and every date fixed by the Court below, if so required by the learned Trial Court.
(iii) In case of absence on two consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be canceled by the Court concerned.
