08-12-2015 Heard Sri Sanjiv Ranjan, learned counsel, who was assisted by Sri Shishir Kumar, learned counsel for the petitioner and Mr. S.Ehteshamuddin, learned Addl. Public Prosecutor. The petitioner, who is in custody since 14-08-2015 in Kanti P.S. Case No. 41 of 2015 registered for the offence under Sections 302, 201/34 of the Indian Penal Code, has prayed for grant of bail.
Learned counsel for the petitioner submits that F.I.R. was lodged against unknown and petitioner's name has transpired only on suspicion, that too on statement made by father of the deceased before the police during investigation. He submits that during investigation, the fact has come that the deceased was in a marriage party, in which, the petitioner was also present with the
Patna High Court Cr.Misc. No.52559 of 2015 (2) dt.08-12-2015 2/2 deceased.
In view of facts and circumstances, particularly; absence of direct accusation, let the petitioner namely Chhunu Ojha @ Ravindra Ojha be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M.
(west), Muzaffarpur/concerned court in connection with Kanti P.S. Case No. 41 of 2015.
