2. The petitioner apprehends his arrest in connection with Kadamkuan P.S. Case No. 678 of 2018 registered under Sections 366 and 379 of the Indian Penal Code.
3. As per prosecution case, the petitioner enticed and took away the daughter of the informant and got married with her.
4. Submission of learned counsel for the petitioner is that petitioner is innocent and has falsely been implicated in the present case. Further submission is that there was love affair between the petitioner and daughter of the informant and they got married. The petitioner is a man of clean antecedent.
5. Learned A.P.P. appearing on behalf of the State vehemently opposed the prayer of the petitioner by contending
Patna High Court CR. MISC. No.16784 of 2024(3) dt.01-05-2024 2/2 that the victim was minor at the time of the alleged occurrence. It is further contended that the victim in her statement recorded under Section 164 Cr. P.C. has categorically stated that she was enticed and taken away to Gujarat by the petitioner and there she was tortured. Hence, it is not a fit case of anticipatory bail.
6. Having considered the facts and circumstances of the case and the statement of the victim girl, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, prayer of the petitioner is rejected.
