Petitioner is accused in connection with Bramhpur P.S. Case No. 314 of 2014 registered under Sections 302/34 of the I.P.C. and 27 of the Arms Act.
The prosecution case is that on 14.11.2014 Ranjit Kumar, brother of the informant along with his uncle and father had gone in the function of Sataisha of grandson of his neighbour Nand Kumar Singh. In that course, informant heard the sound of firing and saw his brother Ranjit Kumar Singh pool with blood sustaining injury on his stomach where his father, uncle and other persons were present, but they were not in a position to speak anything. The injured was rushed to Paras Hospital, Patna where he died.
Learned counsel appearing on behalf of the
Patna High Court Cr.Misc. No.48348 of 2015 (2) dt.06-11-2015 2/2 petitioner submits that informant gave his fardbeyan on 15.11.2014 at 10.10 am. in the Hospital, in which he disclosed that his father and uncle were present at the place of occurrence while the informant in his fardbeyan recorded on the same day at 7.30 am., did not state about the presence of his father and uncle at the place of occurrence. Late on, father of the informant disclosed the name of this petitioner and Rinku Singh saying that at the order of petitioner, co-accused Rinku Singh shot fired at the deceased. Further, submission of learned counsel for the petitioner is that Rinku Singh has already been allowed bail by a Bench of this Court vide Cr. Misc. No. 20303 of 2015 on 06.10.2015. It is also submitted that petitioner is in custody since 21.07.2015, having no criminal antecedent.
Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Buxar in connection with Bramhpur P.S.
