2. The petitioner seeks regular bail in connection with K. Hat (Sahayak) Police Station Case No. 1054 of 2022 registered for the offence under Sections 363, 365 and 302 / 120B of IPC.

3. As per the prosecution case, the son of the informant, namely, Suchit Kumar @ Paltu disappeared since 06.10.2022 at 4 PM. On that date, one unknown boy came and his son had gone with him. Informant searched his son but he could not trace out.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. He further submits that the petitioner is in custody since 13.09.2023.

5. However, learned APP for the State vehemently opposed the prayer for regular bail.

6. On perusal of the FIR and impugned order dated 02.01.2024, it appears that on the basis of written report of the informant, namely, Naresh Dass FIR was registered against unknown persons, during investigation one co-accused Sanjay Kumar Chaurasiya son of Satan Chaurasiya was arrested on the basis of confessional statement of co-accused person. Dead body of the deceased Suchit Kumar @ Paltu was recovered.

Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with K. Hat (Sahayak) P.S. Case No. 1054 of 2022.
