The petitioner seeks bail in a case registered for the offences under Sections 307 and 385 of the Indian Penal Code. The informant named the petitioner along with other accused persons and alleged that they came to his wine shop and demanded extortion. Further, the petitioner is alleged to have assaulted the informant by iron rod which hit his left eye. Vidyasagar Singh and Ranjeet Singh are also alleged to have assaulted Arun Kumar Singh by iron rod and they took money from the chest of the shop.

It is submitted that there is a counter version. Aurangabad (Town) P.S. Case No. 215 of 2014 was lodged by

Patna High Court Cr.Misc. No.45049 of 2014 (2) dt.18-02-2015 2/2 the petitioner and the petitioner also alleged that the informant Sushil Kumar Singh and others came to his wine shop and demanded wine.

From perusal of the record it appears that the informant alleged that the petitioner assaulted him which hit on his left eye. From the injury report it appears that Sushil Kumar Singh got three injuries; one on left eye and another two bruises on the left side of the back and in front of the neck. All the injuries are opined by the Doctor to be simple in nature, but the informant was treated in ANMCH. The injuries were on his cervical spine, which show that occipital bone of scalp was found to be fractured. The petitioner is not the author of the injuries. The petitioner is in jail since 27.9.2014.

Considering the facts aforesaid, the petitioner, named above, is directed to be enlarged on bail on furnishing bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad, in connection with Aurangabad (Town) P.S. Case No.213 of 2014.
