JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-02-2019 This is an application for grant of anticipatory bail in connection with Pandaul P.S. Case No. 03 of 2014, disclosing offences under Sections 395 and 397 of the Indian Penal Code. Allegation against the petitioner is of dacoity in the house of the informant. Petitioner is not named in the F.I.R., later on, his name transpired on the confessional statement of two co-accused persons.

Submission of learned counsel for the petitioner is that except confessional statement there is absolutely nothing against the petitioner and he has no criminal antecedent. Heard learned A.P.P. also.

Having heard both sides, considering the facts and circumstances of the case and the nature of allegation, I am not inclined to grant anticipatory bail to the petitioner, however if

Patna High Court CR. MISC. No.11908 of 2019(2) dt.27-02-2019 2/2 the petitioner surrender before the court below within a period of six weeks and make prayer for regular bail, which will be considered on the basis of materials available on record, if possible, to be disposed of on the same day.

Accordingly, this application is dismissed.
