The petitioner is accused in connection with Kumarkhand P.S. Case No. 112 of 2012 registered under Sections 395 and 397 of the Indian Penal Code.
Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. rather his name has come in the confessional statement of co-accused, Molim Mian @ Moima Mian, as detailed in paragraph 49 of the case diary, showing the involvement of the petitioner and others in the present case. It is further submitted that alleged articles said to be recovered from the house of Molim Mian @ Moima Mian and also the
Patna High Court Cr.Misc. No.25778 of 2015 (3) dt.05-10-2015 articles are said to be recovered from the house of the petitioner are general household articles. It is further submitted that coaccused, Molim Mian @ Molma Mian and others have already been granted privilege of bail by a Bench of this Court vide order dated 23.09.2015 passed in Criminal Misc. No. 12393 of 2013 and petitioner is in custody since 10.03.2015.
Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Madhepura, in connection with Kumarkhand P.S. Case No. 112 of 2012. Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
