====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 27-04-2023 Heard learned counsels for the petitioner and the State.

Petitioner apprehend arrest in a case registered for the offences punishable under Sections 304(B)/34 of the Indian Penal Code and later on Section 302 of the Indian Penal Code was added.

It is a case of dowry death. It is alleged that this petitioner along with the other F.I.R. named accused person killed the daughter of the informant by strangulating her neck due to non-fulfillment of demand of dowry.

Petitioner is mother-in-law of deceased.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in

Patna High Court CR. MISC. No.10794 of 2023(2) dt.27-04-2023 2/2 this case. He next submits that specific accusation is against Devar of the deceased who is already in custody since 25.08.2022. Petitioner is separate in mess and property and is not concerned with the family affairs of the couple. Petitioner has got clean antecedent.

Considering the aforesaid facts and nature of accusation, let the above named petitioner in the event of her arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Motihari, District East Champaran in connection with Harsidhi P. S. Case No. 15 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) Navya/- U T
