Nadim Seraj, learned Government Pleader No.5, appearing on behalf of the State-respondents.

In compliance with the order, dated 27.09.2016, respondent No.4, namely, the Senior Superintendent of Police, Muzaffarpur, and respondent No.7, namely, the Investigating Officer of Sadar P.S. Case No.46 of 2009, are present, in person. A supplementary counter affidavit has also been

Patna High Court Cr. WJC No.887 of 2016 (4) dt.03-10-2016 2/2 filed on behalf of the respondents. The supplementary counter affidavit shows that, upon investigation, the Police has submitted a police report in the form of final form, under Section 173(2)(i) of Cr.P.C.

In view of the above, the writ petition is closed with liberty given to the petitioner to make appropriate application as regards acceptance or otherwise of the said police report, in future, if so advised, and/or take recourse to such provisions of law as may be permissible.

With the above observation, this writ petition stands disposed of.
