The petitioner seeks bail in a case registered under Sections 341, 324, 307, 354(B), 354(D)/34 of the Indian Penal Code and Sections 8, 12 of the POCSO Act.

Allegation is that the accused persons including the petitioner surrounded the daughter of the informant and molested and tried to kidnap her. On protest, the petitioner has inflicted a knife blow on the body of victim. It has been submitted on behalf of the petitioner that the petitioner is in custody since 23.09.2019 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. Single knife blow is alleged to have been

Patna High Court CR. MISC. No.9155 of 2020(2) dt.04-03-2020 2/2 given. The injury is said to be on non-vital part of the body. Hence, no offence under Section 307 of the I.P.C. is made out. The petitioner had no intention to commit murder of the victim. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J. 1st, Lakhisarai in connection with POCSO case No.47 of 2019 arising out of Lakhisarai P.S. case No.714 of 2019.
