JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-02-2019 Petitioner seeks bail in anticipation of his arrest in connection with Special Case No. 18 of 2018, arising out of Jogbani P.S. Case No. 221 of 2018 registered for the offences punishable under Sections 21, 22 of the N.D.P.S. Act and Sections 27(b), 28, read with Section 36 of the Drugs and Cosmetic Act.

Allegation is of recovery of 740 bottles of 100 ML each of Dialex-DC cough syrup and petitioner is named by apprehended accused persons along with Dinesh Paswan as suppliers.

Submission of learned counsel for the petitioner is that except confessional statement there is nothing against the petitioner and co-accused Dinesh Paswan has been granted

Patna High Court Cr.Misc. No.9209 of 2019(2) dt.19-02-2019 2/2 privilege of anticipatory bail vide order dated 21.1.2019 in Cr.Misc.No. 67699 of 2018 by a co-ordinate Bench of this Court.

Having heard both sides and in the facts and circumstances, let petitioner, above named, in the event of arrest or surrender within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Special Judge (N.D.P.S.)- cum-District and Sessions Judge, Araria, in connection with Special Case No. 18 of 2018, arising out of Jogbani P.S. Case No. 221 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned and further condition is that petitioner has to co-operate in investigation.
