JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-02-2020 Petitioner seeks regular bail in connection with Turkauliya P.S. Case No. 668 of 2019 registered for the offence punishable under Sections 25(1-b)a, 26, 35 of the Arms Act. Allegation as per F.I.R. is of recovery one country made pistol and two live cartridges. Apart from that petitioner is an accused in two other cases.
Submission of the learned counsel for the petitioner is that he has falsely been implicated in this case. He is in custody for more than five months.
Heard learned A.P.P. also.
Having heard both sides, in view of the facts and circumstances, as stated above, let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/-
Patna High Court CR. MISC. No.7434 of 2020(2) dt.18-02-2020 2/2 (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of Chief Judicial Magistrate, Motihari, East Champaran, in connection with Turkauliya P.S. Case No. 668 of 2019, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned with further condition that after release, he has to appear before the police of his local area for a period of six months or till the conclusion of the trial, whichever is earlier, so that the police may watch his conduct, otherwise his bail bond shall be cancelled.
Let a copy of this order be communicated to the S.P. East Champaran, for needful.
