2 The instant writ petition seeks to assail the cancellation of petitioner's bond of four years enlistment as Home Guard. This writ petition has been filed after a lapse of five years from the date on which the bond of enlistment was cancelled on grounds of some indiscipline during discharge of duty.

Patna High Court CWJC No.4001 of 2020 dt.21-09-2022 2/2 3 The learned State Counsel submits that apart from the fact that the writ petition is barred by delay and laches, it is also obvious from Annexure 6 of the writ petition, being a representation dated 21.11.2018, that the petitioner has crossed the age of superannuation, admittedly, in the year 2019 - 2020 and, therefore, as of today, the relief of allowing the petitioner, to submit a bond of enlistment, cannot be granted. 4 This Court finds force in submission of the State Counsel, which is based on the records.

5 In view of the aforesaid position, this writ petition is dismissed.
