JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-02-2020 The petitioner seeks regular bail in connection with Bihariganj P.S. Case No. 35 of 2019 (S.T. No. 296 of 2019), registered for offences punishable under Section 366(A)/34 of the Indian Penal Code.

Allegation is of kidnapping of the minor daughter of the Informant.

It has been submitted on behalf of the petitioner that para 36 of the case diary disclosed that while the petitioner was arrested the victim was moving with the petitioner and there is love affairs between the victim girl and the petitioner and later on the pressure of her parents she stated under Section 164 Cr.P.C. against the petitioner. It has further been submitted that in the statement of the victim recorded under Section 164 Cr.P.C. there is no allegation of physical or sexual assault

Patna High Court CR. MISC. No.6971 of 2020(3) dt.27-02-2020 2/2 against the petitioner. Further, the petitioner has no criminal antecedent and he has been in judicial custody since 02.02.2019. Heard learned A.P.P. who has opposed the prayer for bail.

Having heard both sides, in view of the above submissions, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned District & Sessions Judge, Madhepura in connection with S.T. No. 296 of 2019 arising out of Bihariganj P.S. Case No. 35 of 2019.
