JUSTICE AMARESH KUMAR LAL ORAL ORDER 29-01-2015 Heard the learned counsel for the petitioner and the learned counsel for the State.
The petitioner apprehends his arrest in a case registered for the offence punishable under Section 364 of the Indian Penal Code.
Considering the fact that after investigation, the petitioner has been exonerated and no case has been found true by the Investigating Officer against him and he has no criminal antecedent, let the petitioner above-named be released on bail in the event of arrest or surrender within a period of four weeks on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabua in Bhabua P.S. Case No.125 of
Patna High Court Cr.Misc. No.45371 of 2014 (2) dt.29-01-2015 2/2 2005 (G.R. No.460/2005) subject to the condition as laid down under Section 438 (2) of the Code of Criminal Procedure and the other following conditions :
1.
One of the bailors will be the close relative of the petitioner.
2.
The petitioner will not indulge in similar or in any other offence.
3.
The petitioner will be well represented in the court.
4.
In case of absence for two consecutive dates or in violation of the terms of the bail, his bail bond will be liable to be cancelled by the court concerned.
