The petitioner is in custody in connection with Excise Case No. 1076 of 2018 (Bhabua P.S. Case No. 860 of 2018) for the offence under Sections 341, 323, 506, 354(B) of the Indian Penal Code and Section 37(1)(2) of the Bihar Prohibition and Excise Act.

Allegation against this petitioner is that he entered into the house of the informant in drunken condition and tried to out rage her modesty.

Learned counsel for the petitioner submits that the petitioner and the informant are co-villagers and due to money transaction, the present case has been lodged. He further submits that the petitioner has got no criminal antecedent and he

Patna High Court Cr.Misc. No.8520 of 2019(2) dt.13-02-2019 2/2 is in custody since 18.12.2018.

Considering the fact that the petitioner has got no criminal antecedent, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Excise, Kaimur (Bhabua) in connection with Excise Case No. 1076 of 2018 (Bhabua P.S. Case No. 860 of 2018).
