Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner seeks regular bail in connection with Khagaria (Muffasil) P.S. Case No. 476 of 2022 dated 26.05.2022 lodged under Sections 302/ 201/ 341/ 323 of the I.P.C.
As per the prosecution case, the father of the accused petitioner has filed this criminal case against his own son for murder of his grand-son.
Learned counsel for the petitioner submits that it has been categorically stated that this occurrence took place in the stage of intoxication and in the stage of intoxication, he was not in a normal state of mind, therefore, sympathetic view may be

Counsel submits that petitioner is in custody since 27.05.2022 and there is one criminal case pending against him under Section 302 of the I.P.C. in which he is on bail. Learned counsel for the State opposes the prayer for bail and submits that it is a unique case in which the petitioner is accused in two criminal cases under Section 302 of the I.P.C. One for killing of his wife and another for killing of his son. Counsel for the State further submits that the petitioner is directed to continue in jail till lifetime of his father. In the present facts and circumstances of this case and the submissions made above, I am not inclined to grant bail to the petitioner, therefore, this bail petition is hereby rejected. The Trial Court is directed to expedite the trial as early as possible.
With this observation, the bail application stands rejected.
