JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 13-02-2019 Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Madanpur Police Station Case No. 290 of 2018, disclosing offences under Sections 341, 323, 427, 504, 506, 379 and 34 of the Indian Penal Code.

The First Information Report is based on written report of the informant, who, appears to be the villager of these petitioners. These petitioners come from a family with common ancestors. It is alleged that they were attempting to influence the Bank Manager of Allahabad Bank, Uchauli Branch, referring to the informant's name, for the purpose of grant of some loan. When the informant refused to recognize these petitioners for the said purpose, they are said to have assaulted the informant and damaged his vehicle.

Let the petitioners, above named, in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate Aurangabad, in connection with Madanpur Police Station Case No. 290 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioners shall present themselves before the police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled. I have kept in mind the fact that the petitioner no. 2 is an accused in two other cases, as mentioned in paragraph 3 of this application, but considering the nature of accusation, the privilege of anticipatory bail is being granted to him.
