The petitioner is accused in connection with Rudrapur P.S. Case No. 91 of 2014 registered under Sections 366, 366A and 494 of the Indian Penal Code pending in the court of Chief Judicial Magistrate, Madhubani.
The accusation is of kidnapping of Rani Kumari, daughter of informant, Mira Devi, by the petitioner. Learned counsel for the petitioner submits that, in fact, petitioner is the Mousha of the victim, aged about 60 years, has falsely been implicated in this case due to ulterior motive. It is further submitted that the statement of the victim, under Section

No.26303 of 2015 (3) dt.05-10-2015 164 Cr.P.C. has been detailed in paragraph 28 of the case diary, in which, she has stated about taking by this petitioner to her on pretext of illness of her father and later on victim was taken by the petitioner at Mathura and forcibly married to the victim but the victim is educated and sufficient to know on which she was boarded at bus or train and also by which place she was traveled. Having considered the facts and circumstances of the case, I am not inclined to grant bail to the petitioner. Accordingly, the prayer for bail of the petitioner is rejected.
