Grievance of the petitioner in the present writ application is non payment of retiral benefit on account of government decision granting the benefit of 4th, 5th and 6th pay revision.

Learned counsel for the petitioner submits that petitioner is entitled to revision of pension as also the benefit of difference of pay and payment of pension, leave encashment,

Patna High Court CWJC No.4288 of 2020(2) dt.24-06-2020 2/2 gratuity including revised D.A. with statutory interest which has not been paid to the petitioner.

Considering the fact that the petitioner superannuated in Sept.,2014, the writ petition is disposed of with a direction to respondent no.1 to take appropriate decision with regard to entitlement of the petitioner and ensure payment of all legitimate post retiral dues as well as pre-retiral dues on account of revision, if not already paid, within a period of three months from the date of receipt/production of a copy of this order, failing which the petitioner shall be entitled to payment of interest @ 9% from the date of retirement till the date of actual payment.

With the aforesaid, the writ application stands disposed of.
