====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 15-04-2019 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner is languishing in custody since 03.07.2018 in a case for the offence registered under Sections 25 (1-A), 25(1-AA), 25(1-B)A, 26(I) (II) and 35 of the Arms Act.

The prosecution story, in brief, is that from physical possession of the petitioner, twenty semi finished pistol is alleged to have been recovered which was kept in a bag. It has been submitted by learned counsel for the petitioner that the petitioner has got no criminal antecedent. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the

Patna High Court CR. MISC. No.8625 of 2019(3) dt.15-04-2019 2/2 petitioner. The petitioner has falsely been implicated in the present case. The petitoner has remained in custody for about nine months. The articles recovered are suspected to be half manufactured firearms. Other co-accused has been granted bail by another Co-ordinate Bench of this Court vide Cr. Misc. No. 12225 of 2019 order dated 01.03.2019.

On behalf of the learned counsel for the State, it has been submitted that the petitioner is named in the F.I.R/ complaint case.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Munger, in connection with Kasim Bazar P.S. Case No. 141/2018.
