The petitioners are apprehending their arrest in a case registered for the offence punishable under Sections 147, 149, 341, 342, 427 and 353 of the Indian Penal Code.
An auto-rickshaw met with an accident and slackness at the end of the police have been perceived by the local inhabitants who, on account thereof, assembled and raised protest and after having presence of police, they ransacked the vehicle, more particularly, two buses bearing Registration Nos. BR 7P 2968, BR 7P 2969 whereupon, FIR, was registered against unknown. Case has been registered in the year 2012 and as is found from the certified copy of the order, cognizance has been taken, vide order dated 04.05.2019. Although, charge-sheet was submitted on 30.04.2018.
Patna High Court CR. MISC. No.9297 of 2020(2) dt.02-03-2020 2/2 Learned counsel for the petitioners submits that there is general and omnibus allegation against the petitioners and they have not committed any offence at all. The petitioners have no criminal antecedent. The similarly situated co-accused have been granted anticipatory bail vide order dated 28.11.2019 in Cr. Misc. No.77358 of 2019.
However, petitioners are agreed to deposit Rs.10,000/- (ten thousand only) in the court below/Nazarat. In the aforesaid facts and circumstances of the case, I am inclined to grant anticipatory bail to the above named petitioners, in the event of their arrest or surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs. 20,000/- (rupees twenty thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Benipur, District-Darbhanga, in connection with Bahera, P.S. Case No. 381 of 2012 corresponding to G.R. No. 385 of 2012, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
