Counsel for the petitioner is directed to remove the defect(s), as pointed out by the office, within a period of four weeks.

The petitioner is apprehending his arrest in connection with Motipur P.S. case No.103 of 2020 registered under Sections 30(a), 41(1)(2) of the Bihar Prohibition and Excise Act, 2016, pending in the court of Special Judge, Excise, Muzaffarpur.

Earlier the anticipatory bail application of the petitioner was dismissed as withdrawn by a Co-ordinate Bench of this Court vide Annexure 1 to the present application by order dated 14.12.2020 passed in Cr.Misc.No.25809 of 2020.

Patna High Court CR. MISC. No.8735 of 2022(2) dt.04-03-2022 2/2 Thereafter, the second anticipatory bail application of the petitioner was again dismissed as withdrawn by a Co-ordinate Bench of this Court vide order dated 29.09.2021 passed in Cr.Misc.No.52305 of 2021.

This is the third anticipatory bail application filed on behalf of the petitioner. I find no reason to entertain the present application as twice the anticipatory bail application has been dismissed by a Co-ordinate Bench of this Court. The present anticipatory bail application stands disposed of with liberty to the petitioner to surrender before the court below and pray for regular bail.

In case, the petitioner surrenders before the court below, same shall be disposed of without being prejudiced by this order.
