JUSTICE SANJAY PRIYA ORAL ORDER 2/ 18-02-2019 Heard learned counsel for the petitioners and learned APP for the State as well as counsel for the informant. Petitioners seek bail in Ramgarhwa P.S. Case No.264 of 2018 instituted for the offence under Section(s) 302/34 Indian Penal Code.
In the written report, there is specific allegation against co-accused, Bhola Ram, of causing Gandasa injury on neck of son of the informant on account of which he died while being taken to hospital. Postmortem report has been enclosed as Annexure- 2, wherein, doctor has found one incised injury on neck of the deceased caused by sharp cutting weapon. Cause of
Patna High Court Cr.Misc. No.9613 of 2019(2) dt.18-02-2019 2/2 death has been said to be aforesaid injury, which was caused within twelve hours.
Counsel for the petitioners submits that petitioners are alleged to be seen running away from the place of occurrence. Petitioners are in custody since 06.11.2018.
In the facts and circumstances of the case, prayer of the petitioners for grant of bail is allowed. Let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, East Champaran, Motihari, in connection with Ramgarhwa P.S.
