JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 31-08-2022 Learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month. Heard learned counsel for the petitioner as well as learned APP for the State.
The petitioner apprehends his arrest in connection with Belhar P.S. Case No. 145 of 2021, registered for the offences punishable under Sections 379 of the Indian Penal Code. The informant Rajesh Singh is a contractor. As per allegation, 150 bags of cement were stolen away from his godown. The informant came to know that his munsi Arun Yadav had committed theft.
Learned counsel for the petitioner has submitted that the petitioner is not named in the FIR. His name has figured in the confessional statement of co-accused Vinod Yadav and the cement
Patna High Court CR. MISC. No.8280 of 2022(2) dt.31-08-2022 2/2 recovered from the house of the present petitioner was for his own use. He has submitted further that the petitioner is a person of clean antecedent.
Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Banka in connection with Belhar P.S. Case No. 145 of 2021, subject to the conditions as laid down under Section 438(2) Cr.P.C.
Learned court below shall examine the criminal antecedent of the petitioner and if it comes to the notice of the court below that the petitioner is involved in any other case except the present one, the learned court below shall be at liberty to cancel his bail bond.
Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court. (Nawneet Kumar Pandey, J) SONALI/- U T
