JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 12-05-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under Sections 392 of the Indian Penal Code and later on Section 411 of the Indian Penal Code was added.
As per the prosecution case, the accused persons looted the informant's bag containing Rs. 2,32,020/- ATM card, Adhar Card, Driving License, Tab of lenovo, PAN Card etc. and fled away.
Learned counsel for the petitioner submits that petitioner was the informant of the case but during investigation he has been made accused in this case. The looted mobile phone was recovered from the possession of coaccused and the petitioner even identified the
Patna High Court CR. MISC. No.9195 of 2023(2) dt.12-05-2023 2/2 accused persons during test identification parade, but later on petitioner was made accused in this case. The petitioner claims clean antecedent.
Learned counsel for the State opposes the bail petition of the petitioner.
Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Purnea in connection with Kasba P.S. Case No. 30 of 2021 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
