JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 02-11-2015 This is an application for grant of regular bail in favour of the petitioner who is an accused in Sahebganj PS Case No. 208 of 2015 for the alleged offences punishable under Sections 25(1-b), 26 and 35 of the Arms Act, 1956 pending in the court of Chief Judicial Magistrate, Muzaffarpur. Learned counsel for the petitioner submits that as per the allegation contained in the First Information Report, from the Indigo Car, a country made pistol loaded with 0.315 bore cartridges were recovered. Another live cartridge was also recovered. It is contended that from the petitioner's conscious possession, nothing incriminating was recovered. It is also submitted that the petitioner has no criminal antecedent and he is in custody since 15.8.2015.
Keeping in view the facts and circumstances of the
Patna High Court Cr.Misc. No.47602 of 2015 (2) dt.02-11-2015 2/2 case, this application is allowed.
Let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in Sahebganj PS Case No. 208 of 2015.
This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
