Petitioners are languishing in judicial custody since 29.12.2018 in connection with Mirganj P.S. Case No. 361 of 2018 for offences punishable under Sections 272/273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition & Excise Act.
The prosecution case, as lodged by the police personnel, is that during vehicle checking they intercepted the motorcycle of the petitioners in a suspicious condition and apprehended both the petitioners. From a bag in the motorcycle 36 litres of country-made liquor was recovered. Accordingly, a seizure-list was prepared.

No.8351 of 2019(2) dt.13-02-2019 2/2 It has been submitted by the learned counsel for the petitioners that they are innocent, bear no criminal history and have been falsely implicated in the aforesaid case and are languishing in judicial custody for more than 1 1⁄2 months. However, learned APP for the State opposes the prayer for bail.
Considering the facts and circumstances and the materials on record, let petitioners, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned 2nd Addl. Sessions Judge cum Special Judge, Excise, Gopalganj, in connection with Mirganj P.S. Case No. 361 of 2018.
