JUSTICE SUDHIR SINGH ORAL ORDER 06-10-2015 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 379, 411, 401 and 34 of the Indian Penal Code. Allegation against the petitioner is of committing pickpocket of Rs.2500/- from the informant. It has been submitted on behalf of the petitioner that earlier he was granted provisional bail vide order dated 11.8.2015 on the ground that he was to perform Shradh Ceremony of his mother. The said provisional bail was for a period of two weeks but the petitioner could not be released on provisional bail. A supplementary affidavit has been filed to that effect.
The petitioner presses bail on the merit of the case. It has been submitted that petitioner is in custody since 31.3.2015. Chargesheet has been submitted in the case. There is no allegation of tampering with the evidence against the petitioner. Petitioner has been made accused due to mistake of fact. As per allegation, it is said that Rs.2500/- was taken from the pocket of the informant.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Patna, in connection with Patna Junction P.S. Case no. 118 of 2015.
