JUSTICE SUDHIR SINGH ORAL ORDER 06-10-2015 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 25(1-A) A, 26 and 35 of the Arms Act. Allegation against the petitioner is that on seeing the police party he tried to flee away but could not succeed and from his possession arms and ammunitions were recovered. It has been submitted on behalf of the petitioner that he is in custody since 9.5.2015. Chargesheet has been submitted in this case. There is no allegation of tampering with the evidence.

As per allegation, one country made pistol along with two cartridges are said to have been recovered from the possession of the petitioner. There is no compliance of Section 100 of the Code of Criminal Procedure. It is further submitted that petitioner may be released after completion of six month from 9.5.2015. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the
