The petitioner, who is in custody since 11.12.2019 and is a person of clean antecedent, seeks bail in connection with Dhamdaha P.S. Case No. 276 of 2019, dated 29.08.2019, instituted for the offences under Section 395 of the Indian Penal Code.

According to the F.I.R., an attempt at burglary in a Bank was made by some unknown miscreants and Rs. 14,000/- was looted away. An attempt was also made to

Patna High Court CR. MISC. No.7493 of 2020(3) dt.29-05-2020 2/2 break open the strong room of the Bank. The petitioner has neither been named in the F.I.R. nor anything incriminating has been recovered from his possession. After three months of the lodging of the F.I.R., the petitioner was called to the police station for interrogation and he was arrested and remanded in this case. There has not been any Test Identification Parade in the case and as stated above, there is no recovery of any incriminating material. Considering the aforestated facts and the period of custody of the petitioner as well as his clean antecedent, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with Dhamdaha P.S. Case No. 276 of 2019.

The application stands allowed.
