2. The grievance of the petitioner is in limited bound to the extent that despite having been superannuated long back in the year 2012, till date the petitioner has been deprived from the arrears of salary on account of 5th and 6th Pay Revision.

3. It is the contention of the petitioner that the other identically situated persons have been allowed the benefit of 5th and 6th Pay Revision and its consequences, but discrimination has been caused and the petitioner has been compelled to approach this Court.

A counter affidavit has been filed on behalf of State respondents, duly sworn by the Special Director, Secondary Education, Bihar, Patna with a categorical averment that in compliance of the judgment rendered in L.P.A. No. 43 of 2016, the Education Department, Government of Bihar has issued Resolution No.1204 dated 01.08.2023 by which a decision has been taken to extend the benefit of 5th and 6th Pay revision from the date, the teachers of Government School have been granted.
5. In pursuant to the aforesaid letter, a direction has also been given to all the District Education Officers and District Programme Officers (Establishment) to comply the said decision vide letter no.1205 dated 01.08.2023.
6. Learned Advocate for the petitioner interjected at the moment and submitted that despite the decision taken by the State, till date the petitioner has not been accorded the benefit.
7. Having considered the nature of the grievance,
Patna High Court CWJC No.2177 of 2025 dt.23-09-2025 3/3 this Court instead of keeping the matter pending, deems it apt and proper to direct the District Education Officer, Rohtas at Sasaram to consider the claim of the petitioner for his arrears of difference of salary on account of 5th and 6th Pay Revision preferably within a period of eight weeks from the date of receipt/production of a copy of this order.
8. Suffice it to observe that in case the claim of the petitioner finds substance and admissible, the monetary benefit shall also be accorded to him within the period stipulated.
9. With the aforesaid direction, the writ petition stands disposed of.
