JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-09-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner being husband of the deceased is languishing in jail custody since 08.10.2013 in a case in which charge sheet has been submitted for the offences punishable under Sections 304B, 201/34 of the Indian Penal Code. The first information report reflects that petitioner had solemnized his love marriage with the deceased 14 months ago but on 29.07.2013, the informant got information about the death of the deceased. Although, it is stated that petitioner used to make illegal demand but no specific overt-act in respect of illegal demand has been mentioned.

No.45247 of 2014 (5) dt.21-09-2015 2/2 Moreover, taking into consideration the period of detention of the petitioner in jail custody as well as facts and circumstances of the case, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, East Champaran at Motihari in connection with Chhatauni P.S. Case No. 174 of 2013.
