The petitioner has preferred the instant application for grant of regular bail in a case registered under sections 394 and 411 of the Indian Penal Code.

As per the prosecution case, four accused persons on two motorcycles are stated to have dispossessed the informant of Rs.48,000/ in cash, his glamour motorcycle, mobile phone besides other articles. It is further stated that the four accused including the petitioner herein was caught and the informant's motorcycle was recovered.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. As would be evident from perusal of the order of the learned Court below, the Pulsar motorcycle on which the petitioner was found,

Patna High Court CR. MISC. No.19013 of 2021(2) dt.16-09-2021 2/2 it is stated that the same belongs to the petitioner for which he produced the relevant documents. He has no criminal antecedent and is in custody since 12.9.2020. Chargesheet has been submitted in the case.

Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the fact of the petitioner not having any criminal antecedent and being in custody for 1 year, this Court directs the petitioner to be enlarged on bail in connection with Parsauni P.S. Case no.71 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi.
