JUSTICE NANI TAGIA ORAL ORDER 22-04-2025 This contempt petition has been filed alleging violation of order dated 24.07.2018, passed in C.W.J.C. No. 10002 of 2018, wherein this Court had passed the following

Patna High Court MJC No.394 of 2019(3) dt.22-04-2025 2/3 order:- "The respondent No.6 i.e. The District Programme Officer (Establishment), Muzaffarpur is directed to examine the case of the petitioners in the light of the cases as referred above and dispose of the case of the petitioners in accordance with law within a period of three months from the date of receipt/production of a copy of this order.

If the petitioners are entitled to the reliefs sought for, the respondents will be obliged to pass an order taking into account the Clause 4. (C)(1) of the State Litigation Policy.

With the aforesaid observation and direction, the present writ application stands disposed of."

2. Opposite party no.6 has filed a show cause, wherein in paragraph nos. 3, 4 and 5, it has been stated as under:- "3. That on the representation of the petitioners this opposite party has examined the claim of the petitioners with the judgment passed in CWJC No.6139/2007 as well as passed in LPA No.756/2015.

4. That by the comparative study of the case of the petitioners to that of Ramashish Tiwari of CWJC No.6139/2007 and LPA No.756/2015, it was found that Ramashish Tiwari had been continuous service of Matric Trained pay Scale w.e.f. 12.12.1998 i.e. the date of the appointment

Patna High Court MJC No.394 of 2019(3) dt.22-04-2025 3/3 without any break for 12 years in pay scale of Matric Trained post were as the petitioners of this case do not fulfill the condition of Ramashish Tiwari because they all could not continue in regular service in Matric Trained Pay Scale for 12 years without any break and this why their case is not similar to that of Ramashish Tiwari.

5. That under the facts stated hereinabove this opposite party rejected the claim of the petitioners by an Office Order bearing Memo No.5427 dated 26.12.2019 considering their claim with the judgment in aforesaid CWJC No.6139/2007 and LPA no.756/2015."

3. On perusal of paragraph nos. 3, 4 and 5 of the show cause filed by opposite party no.6, I find that the order dated 24.07.2018, passed in C.W.J.C. No. 10002 of 2018 has been complied with by the respondents.

4. In view of the above, the present contempt petition stands closed and disposed off.
