The petitioner seeks bail in a case instituted for the offences under Sections 467, 468, 471, 420 and 120(B) of the Indian Penal Code and Sections 25(1-b)a, 26 and 30 of the Arms Act.
It has been alleged that petitioner was posted as security guard at IDBI Bank, Kirani Ghat. The police has asked for production for his arms licence whereupon the petitioner could not produce licence and later on produced a licence of third person and on account of that he was taken into custody. Learned counsel for the petitioner submits that petitioner is doing the job of security guard for his livelihood
Patna High Court Cr.Misc. No.49192 of 2015 (2) dt.04-11-2015 and was holding a gun of which licence is of third person. There is no allegation of misusing the arms. The petitioner is in custody since 26.6.2015.
Looking to the period of custody, let petitioner, Anil Kumar, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya in connection with Kotwali P.S. Case No.270 of 2015.
