Patna High Court CR. MISC. No.1438 of 2022(3) dt.06-01-2023 2/3 The two petitioners in the two applications have prayed for grant of regular bail in a case registered under section 392 of the Indian Penal Code.
As per the prosecution case, the three accused persons on a motorcycle looted the informant of his bag containing Rs. 1,32,160/- besides other articles as mentioned in the FIR. It is submitted by learned counsel for the petitioners that the FIR was registered against three unknown. The name of the petitioners transpired in course of investigation in the confessional statement of the co-accused made before police. The said co-accused has already been enlarged on bail. Inspite of being in custody the petitioners have not been put on T.I. parade and chargesheet has been submitted in the case. The petitioners are in custody since 18.12.2019 and 26.7.2021.
Heard learned APP for the State Having heard learned counsel for the parties and taking into consideration the nature of allegation, the material that has transpired in course of investigation, the petitioners being in custody 18.12.2019 and 26.7.2021 and chargesheet having been submitted in the case, both the petitioners are directed to be enlarged on bail in connection with Bakhtiyarpur P.S.
