The petitioner seeks bail in connection with Murar P.S. Case No. 90 of 2023 instituted for the offence under Sections 413 & 414 of the Indian Penal Code. 3.

Prosecution case in short is that there is recovery of one stone motorcycle from the co-accused, namely, Vikash Kumar. It is further alleged that motorcycle in question was purchased from the instant petitioner and petitioner along with co-accused used to sell stolen motorcycles.

It has been submitted on behalf of the petitioner

Patna High Court CR. MISC. No.14038 of 2024(2) dt.07-03-2024 2/3 that the petitioner is in custody since 17-10-2023. Petitioner is a man of clean antecedent.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. Petitioner was not apprehended on the spot. Name of the petitioner has transpired on the basis of confessional statement of co-accused, namely, Deepu Kumar, who has been allowed bail by a Co-ordinate Bench of this Court vide order dated 2202-2024, passed in Cr. Misc. No. 10688 of 2024. Other coaccused has been granted bail by a Co-ordinate Bench of this Court, vide order dated 31-01-2024, passed in Cr. Misc. No. 4539 of 2024.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 7.

Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner, clean antecedent of the petitioner and claim based on parity, this Court is inclined to grant bail to the petitioner.

Let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Murar P.S.
