JUSTICE SANJEEV PRAKASH SHARMA ORAL ORDER 04-01-2022 Heard both the parties through video conferencing. The petitioner seeks bail in anticipation of his arrest in connection with Khajauli P.S. Case No.209 of 2020 instituted for the offence under Section 376 of the Indian Penal Code. Learned counsel for the petitioner submits that there was love affair between the petitioner and the prosecutrix and the present F.I.R. is an outcome of the petitioner having refused to marry with the prosecutrix.

Learned counsel for the State submits that the statement of the prosecutrix has been recorded under Section 164 Cr.P.C., where she has stated that she was raped by the petitioner.

Taking into consideration the same, I am not inclined to grant anticipatory bail to the petitioner.
