The petitioner is languishing in custody since 02.09.2018 in connection with Lakhisarai P.S. Case No.529 of 2018 registered for the offences punishable under Sections 25(1-B)a, 26, 35 of the Arms Act.

Prosecution case as per the FIR is that from possession of the petitioner, one country made pistol and five cartridges were recovered.

It is submitted by learned counsel for the petitioner that the investigation has already been concluded. The petitioner is accused in one other case apart from the present one. Learned A.P.P. vehemently opposed the prayer for bail

Patna High Court Cr.Misc. No.7959 of 2019(2) dt.13-02-2019 2/2 and submits that the recovery has been made from the petitioner. Considering the fact that the investigation has already been concluded and period under custody, let the above named petitioner be enlarged on bail on furnishing bail bond of Rs.10000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai in connection with Lakhisarai P.S.
