JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 30-11-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The alleged occurrence took place in the year, 1994. The petitioner filed anticipatory bail petition, which was rejected up to this court in the year, 2006 and this court directed the petitioner to surrender before the court below but petitioner did not take pain to follow the order of this court. Moreover, it would appear from perusal of the impugned order that victims specifically, stated in course of investigation that this petitioner committed rape upon them.

Therefore, considering the aforesaid facts and circumstances as well as submission of the parties, I am not inclined to release the petitioner on bail and accordingly, his

Patna High Court Cr.Misc. No.53774 of 2015 (2) dt.30-11-2015 2/2 prayer for bail in connection with Banmankhi P.S. Case No. 124 of 1994 pending in the court of learned Chief Judicial Magistrate, Purnea stands rejected.
