The petitioner is a Contractor having been brought under the purview of E.S.I. Act and, after that, a proceeding under Section 45-A was initiated and an amount of Rs. 2,52,038/- has been calculated to be liable to be paid and, against that, he has filed an appeal under Section 45-AA of the E.S.I. Act without depositing the statutory amount of 25% of the computed amount.

In the petition, the petitioner has stated that he was ready to deposit the money but, the time was not granted and he

In that view of the matter, if the petitioner deposits the 25% of the calculated amount within a period of four weeks from today, in that event, his appeal will be heard and decided on its merit but, in failure to deposit the aforesaid amount within the aforesaid period of four weeks from today, the order dated 6.11.2017 will remain intact.
